INPULSE LAB (hereinafter "INPULSE"), with its registered office at Insurgentes Sur 427, Floor 11, Colonia Hipódromo, Cuauhtémoc, 06100 Mexico City, United Mexican States, is responsible for the processing of personal data (hereinafter “Personal Data”) that you (hereinafter “You” or the “Data Subject”) provide to us, which will be protected in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter “Personal Data Law”), and any other applicable regulations.

This Privacy Notice describes your rights regarding the collection, use, storage, processing, transfer, and protection of your Personal Data by INPULSE. This Privacy Notice applies to the collection of Personal Data directly, including access to our offices, as well as to any website owned by INPULSE, including related sites, mobile applications, digital platforms, and tools owned by INPULSE, regardless of the form and place of access.

This Privacy Notice applies within the United Mexican States.

CATEGORIES OF DATA SUBJECTS

At INPULSE, we process the personal data of various categories of data subjects. This Privacy Notice is addressed to visitors of the website https://inpulselab.in, users of our services, including those who purchase a product and/or service offered by INPULSE.

PURPOSES OF PROCESSING

The Personal Data we have, collect, or will collect from you will be the Personal Data you voluntarily provide through the various forms on the INPULSE website, through which you request any product and/or specific or general information, as well as Personal Data that we may collect through cookies, web beacons, and other technologies in accordance with the "USE OF COOKIES AND WEB BEACONS" section of this Privacy Notice.

The Personal Data we collect from you will be used for the following purposes necessary to:

• Identify users and verify their identity;
• Provide INPULSE services;
• Invoice the services;
• Manage our relationship with you, including contacting you to fulfill any contractual or legal obligations.

PERSONAL DATA COLLECTED

• Name and surname of the person;
• Corporate name of the company;
• Name and surname of the person with sufficient authority to represent the company and commit it in its name and on its behalf;
• Email address of the authorized representative;
• Phone number;
• Federal Taxpayers Registry (RFC) of your company;

INPULSE will only have access to the information that the Data Subject voluntarily provides in person and directly. Therefore, INPULSE will only be able to collect and store the following Personal Data from the Data Subject, to carry out the purposes described in this Privacy Notice.

The processing of the collected Personal Data will be necessary, adequate, and relevant for fulfilling the purposes mentioned in this Privacy Notice, as well as for the additional purposes described in this document.

All Personal Data collected from the Data Subjects will be stored in INPULSE's database (hereinafter "Database"), which has high security measures to ensure the privacy and protection of the collected Personal Data against damage, loss, alteration, destruction, or unauthorized use, access, or processing. INPULSE will store the collected Personal Data for as long as necessary to fulfill the purpose for which it was collected, as well as for the time permitted by applicable legislation.

Therefore, Personal Data is protected both online, through encryption codes, and offline, as only designated personnel with specific tasks related to Personal Data have access to the Database.

INPULSE may contact the Data Subject via email, phone, or other authorized means to inform them about new products and/or services, as well as any changes to the operational rules of products and/or services and/or this Privacy Notice.

In the event INPULSE is acquired by a third party, the collected Personal Data will be transferred to the acquiring entity. In such a case, the acquirer, as the new data controller, will continue to maintain the necessary administrative, technical, and physical security measures to ensure the privacy and protection of the Data Subject's Personal Data against damage, loss, alteration, destruction, or unauthorized use, access, or processing in accordance with this Privacy Notice.

WAYS TO LIMIT THE USE OR DISCLOSURE OF YOUR PERSONAL INFORMATION

In addition to the procedure outlined in the previous section, you can limit the use or disclosure of your Personal Data as follows: send an email to admin@inpulselab.in requesting written confirmation that your Personal Data is not and will not be processed for secondary purposes.

YOUR PERSONAL INFORMATION IS PROTECTED

Your personal information will be safeguarded under strict confidentiality, and to reasonably prevent the misuse or unauthorized disclosure of the same, we have implemented physical, technical, and administrative security measures in accordance with applicable regulations.

TRANSFER OF YOUR PERSONAL DATA

Please be informed that your Personal Data may be transferred, without your explicit consent being legally required, to the following individuals or entities:

• Authorities to whom we must communicate your personal information in accordance with the law, for the purpose of complying with relevant regulations, as well as for the recognition or exercise of any right;
• Where applicable, other transfers provided for in Article 37 of the Personal Data Law.

We do not carry out transfers that require your consent.

CONSENT

As the Data Subject of your personal data, you acknowledge that:

• You have read and understood this Privacy Notice;
• In accordance with Article 8 of the Personal Data Law, you give your explicit consent to the collection, use, storage, processing, transfer, and protection of your Personal Data by INPULSE;
• The use of our website and, in general, our services constitutes tacit confirmation of your consent to the provisions of this Privacy Notice.

WAYS TO EXERCISE YOUR RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION, AND OBJECTION (ARCO) AND REVOCATION OF CONSENT FOR THE PROCESSING OF PERSONAL DATA. 

You have the right to know what Personal Data we have about you, for what purposes it is used, and the conditions of its use (Access). You also have the right to request the correction of your personal information if it is outdated, inaccurate, or incomplete (Rectification); to request that we delete it from our records or databases when you believe it is not being used in accordance with the principles, duties, and obligations set forth in the regulations (Cancellation); as well as to oppose the use of your Personal Data for specific purposes (Objection). These rights are known as ARCO rights.

You may also revoke the consent you have given us. However, it is important to note that not all requests may be processed or the use may be concluded immediately, as we may be required to continue processing your Personal Data due to a legal obligation.

The Privacy Officer of INPULSE will be responsible (hereinafter “Responsible”) for processing and handling requests from Data Subjects for Access, Rectification, Cancellation, or Objection and/or for revoking consent for the processing of their Personal Data.

To exercise any of the ARCO rights and/or to revoke your consent, you may submit a written request to the Privacy Officer at Insurgentes Sur 427, Floor 11, Colonia Hipódromo, Cuauhtémoc, 06100 Mexico City, United Mexican States, or by email to: admin@inpulselab.in. The request should include:

• The name of the Data Subject and their address or any other means for receiving notifications;
• Documents proving the identity of the Data Subject, and if applicable, the authority and identity of their representative;
• A clear and precise description of the Personal Data concerning which any of the ARCO rights is being exercised (except for the right of access) and/or revocation of consent for its processing;
• A description of the ARCO right being exercised, or what the Data Subject requests (e.g., revocation of consent for processing); and
• Any other element or document that facilitates the location of the Personal Data, if applicable.

The obligation to provide access to the information will be fulfilled when the Personal Data is made available to the Data Subject, or through electronic documents.

If the Data Subject requests access to data from a person who is presumed to be responsible and this turns out not to be the case, it will be sufficient to inform the Data Subject as referred to in this paragraph, to fulfill the request.

In the case of requests for the rectification of Personal Data, the Data Subject must indicate the modifications to be made and provide documentation supporting their request.

The Responsible will communicate the determination made to the Data Subject within a maximum period of 20 (twenty) days from the date the request for Access, Rectification, Cancellation, or Objection or revocation of consent was received, so that, if applicable, it will be made effective within 15 (fifteen) days following the date the response is communicated. For requests for access to Personal Data, delivery will proceed after verifying the identity of the requester or legal representative, as appropriate. The aforementioned deadlines may be extended once for an equal period, provided that the circumstances of the case justify such extension.

REVISION OF THIS PRIVACY NOTICE

This Privacy Notice may be subject to changes, updates, or modifications resulting from new legal requirements, changes in our practices, or other causes. Any changes will be communicated through our website.
